SUBJECT: REPLY TO A NOTICE OF VIOLATION – REPORT NO. 99901294/96-01
The following is Algor’s response to the Severity Level IV violation of 10CFR Part 21.12 (b) which states "...Algor, Inc. did not inform NRC licensees of deviations within five working days of discovery when informing licensees of the deviations identified by Algor, Inc., Quality Assurance Bulletins Nos. 68, 69, 71, 84, 100, 101, and 102."
Please note that QAB 100, 101 and 102 did not exist as of May 22, 1996. Quality Assurance Bulletin No. 90, dated April 12, 1996 is the last Quality Assurance Bulletin as of May 22, 1996.
The reason that the previously mentioned Quality Assurance Bulletins exceeded the five working day notification period was to provide Algor customers with a suggested work around to the deviations identified. Corrective action has already taken place whereby customers will be notified of future deviations identified by the Quality Assurance Bulletin program within five working days regardless of the availability of a suggested work around to the deviation. In the event that Algor cannot suggest a work around to our customers within five working days, Algor will notify the customer that a suggested work around is pending and will be sent as soon as it is available.
Modification to the Quality Assurance Bulletin notification policies which require notification of Algor customers within five working days has been made to the Algor Procedures Manual to prevent reoccurrence of this violation (see Section 7.3 Item 1 of attachment). Full compliance with this policy is already in place. Please feel free to contact us if there are any questions to this response.
