October 22, 1998

Mr. Michael L. Bussler, President and Chief Executive Officer
Algor, Inc.

Pittsburgh, PA 15238

SUBJECT: CLARIFICATION TO REPLY TO NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 99901294/96-01)

Dear Mr. Bussler:

On June 21, 1996, the staff responded to your May 24, 1996, reply to our Notice of Violation (NOV) identified in NRC Inspection Report 99901294/96-01. The violation was classified as severity level IV, which is the least sevious (sic) of violations cited. The violation involved failure to provide timely notification to NRC licensees of deviations, as required by 10 CFR 21.21(b).

Upon further review of your letter, the staff has concluded that the corrective actions taken by Algor are acceptable to correct the deficiency and sufficient for the staff to close the NOV. The staff has concluded its review of this issue and plans no further inspection to verify implementation of corrective action.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter will be place in the NRC Public Document Room.

Sincerely,

Brian W. Sheron, Acting
